Challenges and successes: General Data Protection Regulation (GDPR) implementation in Italy and Germany | Sfide e successi: attuazione del Regolamento Generale sulla Protezione dei Dati (GDPR) in Italia e Germania

Abstract

The General Data Protection Regulation (GDPR) has significantly improved data security in the EU but has raised—since its adoption—numerous issues. Starting with the significant differences in the application of the GDPR between Italy and Germany, the contribution examines the main challenges that the two different domestic systems have had to face in relation to the GDPR, including the need to create legal uniformity and harmonize it with existing national legislation, as well as the issue of compliance costs. The issue of higher fines imposed under the GDPR is also addressed, finally providing information on the application models and their effects on businesses.

Il Regolamento generale sulla protezione dei dati (GDPR) ha migliorato notevolmente la sicurezza dei dati nell'UE, sollevando tuttavia – sin dalla sua approvazione- numerosi problemi. Muovendo dalle differenze significative nell'applicazione del GDPR tra Italia e Germania, il contributo esamina le principali sfide che i due diversi ordinamenti interni hanno dovuto affrontare in relazione al GDPR, tra cui la necessità di creare uniformità giuridica e di armonizzarla con la legislazione nazionale vigente, nonché la questione dei costi di conformità. Si affronta, inoltre, il tema delle sanzioni più elevate imposte ai sensi del GDPR fornendo, infine, informazioni sui modelli di applicazione e sui loro effetti sulle imprese.
