“Inventare il diritto”: nuove categorie per nuovi soggetti? | “Inventing law”: new categories for new subjects?

Abstract

Il contributo prende le mosse dal dibattito sulla personalità giuridica animale e prova a offrire alcuni spunti interpretativi per ripensare al diritto come forma di protezione della vita animale nella sua relazione, spesso problematica, con l’umano. Si ipotizzerà quindi una dismissione dell’utilizzo di categorie prettamente umane, nate per la persona (umana), e la possibilità di guardare verso orizzonti nuovi: laddove gli schemi normativi fin qui percorsi dal legislatore non hanno saputo affermare il rispetto della “vita animale” come valore fondamentale dell’ordinamento, occorre forse rivedere quei dispositivi, o crearne di nuovi. Ciò nell’ottica di incoraggiare un posizionamento dell’ordinamento giuridico realmente protettivo della vulnerabilità animale.

The contribution takes as its starting point the debate on animal legal personhood and attempts to offer some interpretive insights to rethink law as a form of protection of animal life in its often problematic relationship with the human. It will thus assume a divestment of the use of purely human categories, born for the (human) person, and the possibility of looking toward new horizons: where the normative schemes used so far by the legislature have failed to affirm respect for “animal life” as a fundamental value of the legal system, there is perhaps a need to revise those devices, or create new ones. This is with a view to encouraging a positioning of the legal system that is truly protective of animal vulnerability.
