Algorithmic Nudging, Hypernudging and the Transformation of Consent in European Private Law | Nudging algoritmico, hypernudging e trasformazione del consenso nel diritto privato europeo

Lavinia Vizzoni

Abstract

This article examines the implications of algorithmic nudging and hypernudging for European private law. It argues that AI-driven choice architectures shape preferences and blur the boundary between influence and manipulation, challenging the validity of consent and traditional doctrines. The paper proposes a design-oriented approach grounded in autonomy, good faith, and emerging EU regulation.

Keywords

algorithmic nudging; hypernudging; consent; private law; AI regulation.
