Abstract


Este trabajo identifica un vacío sistémico en la fragmentación normativa entre el GDPR, el DSA y el AI Act, y propone, de lege ferenda, al “sujeto artificial” como un centro funcional de imputación. El uso de la inteligencia artificial y el tratamiento algorítmico de datos personales revelan déficits de coordinación regulatoria y deficiencias en la atribución de responsabilidad. En este contexto, la categoría propuesta, desprovista de toda dimensión antropológica, opera como un instrumento de recomposición normativa, orientado a reforzar la accountability e introducir un modelo más coherente de imputación en los procesos de toma de decisiones automatizadas.

This work identifies a systemic gap in the normative fragmentation between the GDPR, the DSA, and the AI Act, and proposes, de lege ferenda, the “Artificial Subject” as a functional center of attribution. The use of artificial intelligence and the algorithmic processing of personal data reveal deficits in regulatory coordination and shortcomings in the allocation of responsibility. In this context, the proposed category, devoid of any anthropological dimension, operates as a tool of normative recomposition, aimed at strengthening accountability and introducing a more coherent model of attribution in automated decision-making processes.
