Online platforms: new vulnerabilities to be addressed in the european legal framework
Abstract
Online platforms play a significant role in facilitating the exchange of goods and services, operating as market makers. Their intermediation function is carried out through the conclusion of a series of unilaterally determined contracts, in which business users have a specific vulnerable position.
Therefore, the need to ensure the growth of this phenomenon led to the adoption of Reg. (EU) No. 1150/2019, “On promoting fairness and transparency for business users of online intermediation services”. The new legal framework seeks to address commercial users' vulnerabilities related to asymmetry of knowledge and bargaining power. The paper aims to analyze this Regulation its problematic aspects.
