Intelligenza artificiale sostenibile e tutela dei green rights | Sustainable artificial intelligence and the protection of green rights

Abstract

Lo scenario contemporaneo caratterizzato dalla rapida diffusione ed evoluzione dell'Intelligenza Artificiale (IA) impone necessarie riflessioni sulla sostenibilità della stessa nella prospettiva antropocentrica della tutela dell’essere umano. Ciò implica, in primo luogo, di indagare la tutela di quei diritti dell’uomo che vengono reinterpretati nella prospettiva della sostenibilità ambientale (green rights), poi approfondita anche nelle altre sue declinazioni. Allo stesso tempo, però, risulta di fondamentale importanza stabilire il perimetro dell’operatività dell’IA al fine di limitarne i rischi per l’essere umano e per i propri diritti, anche tramite adeguati strumenti di diritto privato per la sostenibilità: dalla responsabilità digitale d’impresa, ai contratti d’impresa, con una particolare attenzione alla misurazione dell’impatto dell’IA e considerando, anche, i c.d. fattori ESG.

The contemporary scenario characterised by the rapid diffusion and evolution of Artificial Intelligence (AI) imposes necessary reflections on its sustainability from the anthropocentric perspective of the protection of human beings. This implies, first of all, investigating the protection of those human rights that are reinterpreted in the perspective of environmental sustainability (green rights), which is then deepened in its other declinations. At the same time, however, it is of fundamental importance to establish the perimeter of AI's operation in order to limit its risks for human beings and their rights, also by means of appropriate private law instruments for sustainability: from corporate digital responsibility to business contracts, with a focus on measuring the impact of AI and also considering the so-called ESG factors.
